A BYLAW TO ESTABLISH SOLID WASTE REMOVAL
SERVICE RATES
WHEREAS section 550 of the LOCAL GOVERNMENT ACT
(RS Chapter 323) authorizes the Council of the City of
NOW THEREFORE the Council of the City of
1. (1) This Bylaw may be cited as the "Waste
Removal Service & User Fee Bylaw (2004)"
2. (1) Waste removal, by the City, from properties, unless otherwise provided in this Bylaw, shall be limited to waste placed on the curb for pick-up by the City or its contractor, provided such waste is securely contained in a plastic bag designated by the City for garbage service (a “City Garbage Bag”).
(2) The
City shall not pick up any waste not contained in a “City Garbage Bag”.
(3) Garbage contained in a “City Garbage Bag” may be taken to a designated City garbage drop off site, if available.
(4)
Garbage
contained in a “City Garbage Bag” shall be placed at the curb only between the

3. (1) Lawful
disposal of solid waste that is not contained in a City Garbage Bag shall be
the responsibility of the owner of the waste.
4. (1) The user fees for solid waste collection and disposal shall be those established in Schedule “A” attached to and forming part of this Bylaw.
3. (1) If any section, subsection, sentence, clause or phrase of this Bylaw is for any reason held to be invalid by the decision of any court of competent jurisdiction, the invalid portion shall be severed and the part that is invalid shall not affect the validity of the remainder.
(2) Bylaws #1603, #1630, #1665, #1695, #1731, #1757, #1777, #1851, #1900, #1945, #1975, #2014, & #2060 and amendments thereto are hereby repealed.

SCHEDULE “A”
1. The City of Rossland shall charge a
flat rate of $50.00 per dwelling unit to fund solid waste collection and disposal services in
Rossland. In addition to the flat rate,
users wishing to utilize curbside pickup service, or a designated City garbage
drop-off site, if available, shall purchase “City Garbage Bags” at the rates
contained in this schedule.
2. “City Garbage Bags” are available in
two sizes, large and small.
a) The retail price charged by the City
for “City Garbage Bags”, sold by the City directly to customers, shall be $1.50
plus GST per large bag and $.75 plus GST per small bag.
b) The wholesale price charged by the City
for “City Garbage Bags”, sold by the City to a business holding a valid
business license issued under the Rossland Business License Bylaw #1965,
“Section 7 - Retail Merchants - located in commercial premises” or any
amendments thereto, shall be $1.25 plus GST per large bag and $.50 plus GST per
small bag.
c) The retail price per “City Garbage
Bag”, charged by Retail Merchants to customers, shall be $1.50 plus GST per
large bag and $.75 plus GST per small bag.
3. A garbage service account balance, which remains unpaid on December 31 in any year, shall be transferred to the tax account of the property being serviced by such garbage service.
4. Payment of the flat rate service fee is compulsory.
5. Service fees invoiced and paid shall not be refunded.
